Hoag Orthopedic Institute, LLC (“HOI” or “we”) is committed to respecting the privacy of your personal information. The following privacy policy (“Privacy Policy”) will inform you of the personal information that we, and our affiliates, may collect from you, and how it is used and disclosed. By accessing or using our website, www.hoagorthopedicinstitute.com (“Website”), or any part thereof, including any products or services provided through the Website, you are acknowledging and accepting the practices described in this Privacy Policy and consent to the collection and use of information as specified below. If you are not willing to accept the terms of this Privacy Policy, please do not use our Website.

This Privacy Policy does not describe how we collect or use your Protected Health Information (as defined by the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”)), which is covered by our Notice of Privacy Practices.

We may modify this Privacy Policy from time to time. If we make changes to this Privacy Policy, we will post those changes on this page next to the “Last Revised” at the top of the page. Please review this page frequently to remain up-to-date with the information we collect, how we use it, and under what circumstances we disclose it. You must review the new Privacy Policy carefully to make sure you understand our practices and procedures. By continuing to access or use the Website after changes to this Privacy Policy become effective, you accept the revised Privacy Policy.

Information Collection

When you visit or access our Website, we may collect some information automatically, such as a domain name and IP Address. The domain name and IP address reveals nothing personal about you other than the IP address from which you have accessed our Website. We may also collect information about the type of Internet browser you are using, operating system, what brought you to our Website, as well as which of our Website pages you have accessed.

Additionally, if you communicate with us regarding our Website, our services, or through the “Contact Us” page of the Website, we will collect any information that you voluntarily provide to us in any such communication, which may include your full name, phone number, email address, or mailing address.

Cookies

We use “cookies” on this Website. A “cookie” is a piece of data stored on a site visitor’s hard drive to help us improve your access to our Website and identify repeat visitors to our Website. For instance, when we use a cookie to identify you, you would not have to log in a password more than once, thereby saving time while on our Website. Cookies can also enable us to track and target the interests of our users to enhance the experience on our Website. Usage of a cookie is in no way linked to any personally identifiable information on our Website.

From time to time, some third party services providers that we engage may also place their own cookies on your hard drive. Note that this Privacy Policy covers only our use of cookies and does not include use of cookies by such third parties.

Most web browsers automatically accept cookies, but you can usually modify your browser settings to prevent the acceptance of cookies, and cookies may be deleted at any time. Note that rejecting cookies may prevent you from using certain features of our Website. The “help” section located in the toolbar of most web browsers will provide instructions for disabling the acceptance of cookies.

Information Use

We use the collected information primarily for our own internal business purposes, such as providing, maintaining, evaluating, and improving our services and Website, and fulfilling requests for information. We may also use the information to provide you with customer support and respond to your inquiries, to process payment on your behalf, as well as create, maintain, customize and secure your account with HOI.

Security

We strive to follow generally accepted industry standards to protect the information submitted to us, both during transmission and once we receive it. If we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a closed lock icon at the bottom of your web browser, or looking for “https” at the beginning of the address of the web page. While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment.

However, as no electronic transmission or storage of information can be entirely secure, no one can guarantee the absolute security or privacy of your information. If you maintain an account with HOI, you are responsible for keeping your account password secure and your account confidential, and for any and all use of your account. If you have reason to believe that the security of your account has been compromised, please notify us immediately in accordance with our contact information set forth below.

Please keep in mind that whenever you voluntarily disclose personal information online – for example, through e-mail, discussion board post, or elsewhere – that information can be collected and used by others. In short, if you post personal information online that is accessible to the public, you may receive unsolicited messages from other parties in return. Ultimately, you are solely responsible for maintaining the secrecy of your personal information. Please be careful and responsible whenever you are online.

Right to Know and Data Portability

Right to Delete

Once we receive your request and confirm your identity (see Exercising Your Rights), we will review your request. We may deny your deletion request, in whole or in part, if compliance would be impossible or involve disproportionate effort for HOI or if retaining the information is necessary for us or our service provider(s) to:

  1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.
  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  3. Debug products to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  8. Comply with a legal obligation.
  9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

We will delete or deidentify personal information not subject to one of these or any other available exception under the CCPA from our records and will direct our service providers to take similar action.

We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.
